SC to hear plea seeking quashing of FIR in Bidar sedition case

The petitioner relying on multiple SC judgments argued that police failed to distinguish between academic discourse/artistic endeavour and sedition, in a free country.
A petition to quash the FIR (first information report) in the Bidar sedition case in which two women were in jail for two weeks, has been filed in the Supreme Court. The women – – the mother and a teacher of an 11-year-old – were arrested after the child participated in a school play in which she delivered a dialogue that was allegedly insulting to Prime Minister Narendra Modi. The case is currently being heard at the trial court after the two were granted bail by the sessions court. Incidentally, a plea demanding the same was being heard by a single-judge bench of the Karnataka High Court. While the case in the HC was filed by a Karnataka-based activist, the case in the apex court has been filed by a Delhi-based social activist, Yogita Bhayana. The Bidar police on January 26 had registered an FIR under Indian Penal Code (IPC) sections 504 (Intentional insult with intent to provoke breach of peace), 505(2) (Statements creating or promoting enmity, hatred or ill-will between classes), 124A (sedition), 153A (promoting, attempting to promote disharmony) and 34 (common intent), against the unnamed President or Head of Shaheen School, and Management persons of Shaheen School and journalist Mohamed Yusuf. This was related to an anti-NRC (National Registry of Citizens) play performed by the students on January 21 in the Shaheen Education Institute. The FIR was based on a complaint by an ABVP worker Neelesh. In the FIR, police had said that the school made minors use foul language against the Prime Minister and spread misinformation with regards to NRC. In her petition, Yogita has contended that the registration of the FIR has violated the fundamental rights of the citizens.  She said, “Despite the well-settled principle of law laid down by this Apex Court in a plethora of judgments, the Karnataka Police failed to distinguish between the academic discourse/artistic endeavour and sedition in a free country and registered a sedition case against the minor school-going children and their parents,” citing multiple Supreme Court judgements. She added, “... in light of the above facts, the petitioner most respectfully submits that ‘freedom of expression’ is supreme and prerequisite in a deliberative democracy which has been clearly violated by the state police authorities by lodging the FIR against school management and a widowed parent of a student who participated in a play ‘criticizing Citizenship Amendment Act, National Citizenship Register and National Population Register’.”

‘Popcorn Monkey Tiger’ review: Soori film is a roller-coaster ride of love, lust and gore

The film, starring Dhananjaya and Niveditha in lead roles, has a reverse chronology screenplay style which works well in many places.
Director Soori’s Duniya is a crazy universe. Once you enter, you cannot find the exit. You have to sit, crawl, bawl like a baby, and absorb the rawness, despite your likes and dislikes. It is only then that the exit gates open. When you look at the journey called life through Soori’s lens, it is always unfair; there are no happy endings. You don’t always get what you want, despite being the ‘hero’. You get what you deserve, and sometimes you don’t even get that because – such is life. Popcorn Devi (Niveditha aka Smitha), a popcorn seller, accidentally ends up in jail and delivers a baby girl there. The inmates take good care of her and one day she finally becomes a free bird and enters the real world. With baby in one hand and a bag in another, Devi gets a dose of reality when the bag with all her money gets stolen. While sleeping at the bus stand, a man steals her baby. With no help from the police, Devi sheds her avatar and becomes a version she can no longer recognise. Tiger Seena aka Monkey Seena (Dhananjaya), a mechanic, is forced by circumstances to pick up the machete. The love of his life, Sumi aka Sumitra (Amrutha Iyengar), leaves him for a well-settled man. Lost in love and life, Seena is forced to go with the flow. His sister (Sparsha Rekha) and her husband, a budding politician, want Seena to press the restart button in his life. But a personal tragedy pushes him to the edge. When ‘married’ Seena meets monster Devi, the roller-coaster ride gets an interesting twist as it is automatically filled with love, lust, emotions and, of course, guns. Men and women cannot exist together, utters the newly-wed Seena. Why? You have to find that out on the silver screen. Dhananjaya, who has graduated from Daali to Seena, is the man of the hour. The movie focuses on his life and how four women try to get him on and off the track alternately. The actor has soaked himself in blood and the character to deliver a splendid performance. He is a natural actor and like water that takes the shape of the container, he has moulded himself to fit every scene. A heartbroken Seena equally impresses you as much as the machete-wielding Seena. In a larger sense though, the movie isn’t about Seena at all. It’s about how four women shape a man’s life. The first one is his girlfriend Sumi. Then comes his wife Girija (Sapthami Gowda), who nags and makes his life hell. To escape from all this, he tries to find solace in Devi. But when Devi becomes Durgi, his life is again thrown out of control. Of all the characters, major and the blink-and-miss ones, it is Devi who stays with you even after walking out of the theatre. She is no innocent, but you find yourself wanting to console her. She is angry at the world, but she is also in distress. When an irked Seena teases her for shedding the saree and getting into a ‘cleavage showing’ dress, she gives it back saying men need to look into a woman’s eyes to find the fire. Soori takes the movie forward in a kind of reverse chronology screenplay style and it works well in many places. But again, there are exceptions. In several places, it looks overdone. It seems as though Soori has taken a slice out of people’s life to write some of the dialogues and scenes, especially the conversation between Seena’s wife and his girlfriend. There is no right and wrong, it is all perceptions fuelled by love and lust. This is what Soori has tried to convey. The narration is very similar to Tagaru, and this may disappoint Soori’s fans. Here too he gives us many quirky characters – Mooga, Galeeju, Sugar, Kushka – to name a few! Mooga aka Don Mooganna (Gotham) is a treat to watch. Also, there is a wonderful surprise for those who were disappointed with the shelving of Kage Bangara, the second part of Kendasampige. Going hand-in-hand with the brilliant cinematography by Shekar is Charan Raj’s fast beat background music. The duo have ensured that there isn’t a single dull moment for the 2.5 hours. The first half has no songs and the second half has a lot of bits and pieces from the hit song Maadeva and a few psychedelic bits. One woman dead, 15 injured after Bengaluru-Kozhikode bus topples near Mysuru

One woman died and 15 persons including the driver were injured in the wee hours of Friday after a Kerala-based Kallada group run interstate bus met with an accident in Mysuru district’s Hunsuru. According to police, the Kerala-bound private sleeper bus with registration number AR 01 J 5220 had overturned near the Meenu Mane Cross in Old Bridge area in Hunsur Town around 1:45 am. The bus was supposed to run from Bengaluru to Kozhikode.  The deceased has been identified as Sherin Francis who was residing in Nagpur. The injured are being treated in a Mysuru hospital. Hunsuru Police have registered a case of Section 304A (Causing death by negligence) of the Indian Penal Code. Three of the injured including the driver’s assistant are critical. The driver Sudheer is among the injured too. The other people who have been injured are Sriraj (26), Anjana (25), Ansaf (27), Login (26), Pahard (20), Sharin (26), Swetha, Bhavisha, Amrutha, Akshaya, Santhosh, Shyini, Shivod. This incident comes just a day after a similar tragedy involving a Bengaluru-Ernakulam Kerala Road Transport Corporation (RTC) bus left 20 persons dead. The bus was hit by a container lorry in Tamil Nadu’s Tirupur. According to police, the driver of the container truck had lost control and hit the median. This led to the separation of the container from the truck. The investigation has also revealed that the container was overloaded with tiles.

Protester detained for holding up ‘Kashmir liberation’ poster at Bengaluru’s Town Hall

A day after a Bengaluru college student Amulya Leona was detained for saying “Pakistan Zindabad” as part of her speech at an anti-CAA anti-NRC protest, another student, Aardra, has been detained by the city police for holding a placard that said “Muslim, Kashmiri, Bahujan, Adivasi, Trans liberation now” during a protest held by Shri Rama Sene in Bengaluru’s Town Hall.  On Friday, Sri Rama Sene, Hindu Jagarana Vedike and Hindu Janajagruthi Samiti, members of which are accused of killing Gauri Lankesh, held a protest in Town Hall to denounce Amulya’s sloganeering during an AIMIM organised protest meeting on Thursday. During the protest, a student named Aardra held a poster that read, “Muslim, Kashmiri, Bahujan, Adivasi, Trans liberation now”, in both Kannada and English. When some Rama Sene members saw Ardra and tried to heckle the student, the police stepped in and took the student into custody. By then however, Sri Rama Sene members and others said that Ardra had held a “Free Kashmir” poster and shouted “Pakistan Zindabad”. However, DCP Chetan said that the claims have not been verified and more details would be revealed upon Ardra’s interrogation. Deputy Commissioner of Police (Central) Chetan Singh Rathore said, “One person named Ardra Narayanan held a sign which said “Kashmir Mukti, Dalit Mukti and Muslim Mukti” on it. The security personnel detained the student immediately and they are being questioned.” While the student has not been formally arrested yet, the SJ Park Police have registered a suo motu FIR under sections 153a (Promoting enmity between different groups either spoken or written, or by signs) and 153b (Imputations, assertions prejudicial to national-integration) of the Indian Penal Code. SJ Park Police told TNM that Ardra was being questioned on whether they were acquainted with Amulya.  News agency ANI quoted Bengaluru Police Commissioner Bhaskar Rao saying that the protester arrested at Town Hall had to be rescued by police from the crowd of Hindu Jagaran Vedike protesters.  On Thursday, Amulya Leona, a student in Bengaluru, started her speech at an event organised at Freedom Park against the Citizenship Amendment Act by saying “Pakistan Zindabad”. Amulya went on to say Hindustan Zindabad. She the started saying, “The difference between Pakistan Zindabad and Hindustan Zindabad…” However, she was dragged from the stage before she could complete the sentence. Amulya was remanded to 14-days judicial custody on Friday morning.  Karnataka Chief Minister BS Yediyurappa has also reacted to Amulya’s speech, and said that Amulya should not be given bail and also alleged that she has links with Naxal organisations and other organisations which want to disrupt peace. He also called for “proper punishment” for her. He further told reporters that the state government will take action against organisations which are allegedly backing her.  “Amulya's father himself has said she should be punished and should not get bail and that he will not seek protection,” the CM said.  Amulya’s father had declared on Thursday night that he won’t defend his daughter’s statement.  With inputs from Alithea Stephanie Mounika and Soumya Chatterjee

Watch: CM Yediyurappa says student who said ‘Pak Zindabad’ should be punished

A case of sedition has been registered against the student Amulya Leona and she was sent to 14-day judicial custody on Friday.
Karnataka Chief Minister BS Yediyurappa on Friday stated that the 20-year-old student who has been charged with sedition for saying ‘Pakistan Zindabad’ in Bengaluru on Thursday has “links with Naxals” and that a probe should be conducted into the organisations who are backing her. Speaking to the media on Friday, the Karnataka Chief Minister said that it has been proven that Amulya Leona, the student, has “links with Naxals” and a proper investigation should be conducted.  “Amulya’s father himself has said that her hands and legs should be broken and she should not be given bail and that he will not protect her. Secondly and more importantly, unless we take action against organisations that are propping up Amulya, there will be no end to this,” Yediyurappa told the media. “It is clear that there are organisations behind her that want to disrupt peace. If we figure out organisations backing her, then we will know who is propping her up and take action against them. It has been proven that she has links with Naxals. A proper investigation will be conducted,” the Chief Minister stated. Amulya Leona had raised "Pakistan Zindabad" slogan thrice after the organisers of the event under the banner of "Save Constitution" invited her to address the gathering in the presence of All India Majlis-e-Ittehadul Muslimeen (AIMIM) chief Asaduddin Owaisi. Amulya is then seen saying Hindustan Zindabad thrice but then the mic in her hand is snatched away. She then steps ahead and says without the mic: "There is a difference between Pakistan Zindabad and Hindustan Zindabad. The reason why I said Pakistan Zindabad...,” but she is interrupted and dragged off the stage by the police. Amulya was immediately taken into custody. A case has been filed against her under Sections 124A (sedition), 153A (promoting enmity between groups through by words or signs), 153B (Imputations, assertions prejudicial to national integration) and 505(2) (statements promoting enmity, hatred or ill-will between classes) of the Indian Penal Code. On Friday, she was sent to 14-day judicial custody. After Amulya was detained on Thursday evening, right-wing groups held a demonstration outside her father’s house at Koppa in Chikkamagaluru. Her father’s house was also vandalised by the protesters. 'What she did was wrong': Video of Bengaluru student's father jailed for sedition being heckled

A video of Amulya’s father being heckled by three men went viral on Thursday night after she was arrested.
Father of journalism student Amulya Leona, was heckled and intimidated outside his house on Thursday night by members of pro-Hindu groups and one local BJP leader. Amulya Leona was arrested by the Bengaluru police on Thursday for saying 'Pakistan Zindabad' on stage at an organised by the All India Majlis-e-Ittehad-ul-Muslimeen (AIMIM) and the Hindu Muslim Sikh Isaai Federation. Amulya has been booked for sedition and is currently in judicial custody. A video of Amulya’s father being heckled by three men went viral on Thursday night after the arrest was made. Amulya’s father, can be seen opening the door and he recognises the three men. The first thing he asks is, “Are you here to kill me?” “Do you justify what your daughter did? Do you think what your daughter did was right?” asks a man in a blue T-shirt. The man in the video is former BJP taluk panchayat leader Rakesh Hirekodige. Amulya’s father says he condemns what his daughter did. "What my daughter said was 100% wrong. She should not have said that," her says. “What will you do once your daughter comes out on bail?” Rakesh asks. “I don’t want her to come outside. Let her stay in jail for six months. I will let her inside my house, she is my daughter. But let her not come now. What she said was wrong, I admit it. Let them break her hands and legs," he says. But the men persist and ask how the father can let Amulya in the house after the 'traitorous things' she has said. Amulya’s father is finally made to give a statement on camera. “I will not tolerate that my daughter said Pakistan Zindabad. Recently she has been mingling with people from the Muslim community and has been saying unacceptable things. I have tried to counsel her about this many times and over the last five days, I have not been in touch with her. Let the authorities take the necessary action against her,” he says. Rakesh then asks him whether he would post his daughter’s bail. Amulya’s father says he will not pay for her bail. “She has hurt not just me but everyone in my family. Bharat Mata Ki Jai,” he says. What happened at Freedom Park Amulya Leona, who was called as a speaker at an event in which AIMIM Chief Asaduddin Owaisi also participated, began her speech by saying “Pakistan Zindabad” thrice. Owaisi, and organisers of the event tried to pull her away and did not allow her to continue speaking. Amulya however went on to say Hindustan Zindabad thrice. "There is a difference between Pakistan Zindabad and HIndustan Zindabad. The reason why I said Pakistan Zindabad...”, she was heard saying. However, she was dragged off the stage by the police before she finished the sentence. Five days before she was slated to speak at the event, Amulya had put up a Facebook post which said “Zindaba to all countries”. On February 16, Amulya had written a Facebook post which said, “Hindustan Zindabad, Pakistan Zindabad, Bangladesh Zindabad, Sri Lanka Zindabad, Nepal Zindabad, Afghanistan Zindabad, China Zindabad, Bhutan Zindabad, No matter which country, Zindabad to all countries.” There are many who have criticised the case of sedition and Owaisi's reaction: Idiotic to charge her with sedition!
