Home buyers say they’ve been left in the lurch after builder delays apartment

Despite favourable verdict by RERA, the buyers say they have not got any relief in this matter.
For around thousand families in Bengaluru, the dream of owning their own house has created a double disadvantage in times of the pandemic induced economic slowdown. Denied their promised home, they also have to shell out house rent in addition to the monthly home loan instalment. Years ago, they had invested money in Skylark Ithaca Apartment in Whitefield, a flagship project of real estate company Skylark Mansions, which promised to deliver the apartments by March 2017 with an additional grace period of 6 months.  A majority of the buyers have paid up to 90% of the costs (around 50 lakhs) to the builder, but they are yet to get their homes from the builder though it is more than three years past the delivery date.  The home buyers say that even the much-hyped Real Estate Regulatory Authority Karnataka (RERA-K) has also failed to provide any real relief to them though they have filed as many as 334 complaints filed with the authority. The RERA judgement directed Skylark to pay compensation in the form of interest @ 10.75% on the amount paid by the buyer towards the purchase of the flat till the notice of possession is issued from April 2018. Another Rs 5,000 should be paid by Skylark to the buyers as damages, RERA said. “Since the RERA rulings were not enforced the homebuyers decided to form an association and approach the police and a complaint was filed at Avalahalli police station by close to 100 home buyers,” one of the buyers and a member of the apartment buyers association said. Krishnan , a buyer, told TNM, ‘After we got a favourable verdict from RERA, the company started approaching various courts to get a stay against the orders. But there has been no relief for buyers like us who are forced to pay our EMIs and home rent at the same time in a crisis like this.” Victims allege while the real estate company is at fault, even their financier ICICI bank is to be blamed for the crisis. “The project consisted of five buildings with a club house under 2 phases. Phase 1 is only 50 percent complete and even the foundation is not in sight in phase 2. This begs a question as to how did ICICI release funds without doing necessary checks on the ground? The construction status is not at par with the funds that were released,”another homebuyer added.  The company however disagrees with this and instead blamed the litigation for the delay. “We have completed close to 90% construction of the first phase and the second phase we have done about 20-22%. Most of the litigants who have gone to court are of Phase 1 allottees. Had they had not gone to court or RERA by now they would have got their flats ready. But now with the litigation and all we are not able to start construction activity,” Prashantha Kumar, counsel for Skylark, said. He claimed that the construction had stopped due to an array of reasons including fault of the subcontractors and disruption in the construction sector with the introduction of GST, RERA, demonetisation and now the pandemic. “All these reasons have created a complicated situation but unfortunately we have now been hit with the litigations that have not allowed us to start construction,” he added. He also denied allegations that money from these projects was diverted to other projects. In a dispute at the National Company Law Appellate Tribunal between ICICI Bank and Skylark, the tribunal on August 10 has ordered scrutiny over the project and ensured that the company is not dissolved.

Elephant calf named after Sudha Murty in Bannerghatta Park as token of thanks

Bengaluru’s Bannerghatta Biological Park said that this was an acknowledgement of Sudha’s contribution to the development of the park.

In a gesture of thanks for her contributions, the Bannerghatta Biological Park has named an elephant calf after author, social worker and chairperson of the Infosys Foundation Sudha Murty. This is an acknowledgement of her contributions to wildlife conservation. The female calf in question was born to a 45-year-old elephant named Suvarna on August 17, which took the population of elephants to 25 in Bannerghatta Biological Park (BBP). She added that Sudha used to personally monitor work at BBP. She also contributed to the development of the Binkadakatti mini zoo that is located in Gadag, Karnataka. A senior Indian Forest Service officer said to IANS, "In the past, I have named one elephant after Tulsi Gowda who was a Padma Shri awardee and worked in the field of environment. She was from Karnataka and had done a lot of plantation work. It was done to recognize her services to environmental causes."  Earlier, the zoo had shared pictures of another elephant named Roopa that had given birth to a calf on August 2 and later shared videos of Roopa’s calf doing well. The calf is seen walking with the herd and its mother. “Calf is suckling well and interacting with the rest of the herd! Man arrested in Bengaluru for creating fake city police FB page

40-year-old Pankaj Kumar is a resident of Malleswaram.
A 40-year-old man from Bengaluru has been arrested for creating a fake Facebook page in the name of the Bengaluru City Police. The accused has been identified as one Pankaj Kumar and is currently in police custody. According to police, he is a resident of Malleswaram in the northern part of the city. He had created the page recently, the police said on Wednesday.  The fake page named ‘Bengaluru City Police’ has been taken down. The official page with the same title (all caps) has a verified blue tick badge. Sandeep Patil, Joint Commissioner of Police, Crime (Bengaluru) confirmed the development. CIty Police Commissioner Kamal Pant also retweeted a tweet made by Patil on the incident. The probe had begun after a complaint was lodged against an unknown person creating an account in the name of Bengaluru City Police complaint with the Central City Crime Branch Police station.  The accused was nabbed after a joint team of the CCB and Cyber Crime police staff conducted a sting operation under the guidance of the Joint Police Commissioner and Deputy Commissioner of Police (Crime). This development comes after the city witnessed an incident of mob violence in DJ Halli and KG Halli Police Station limits on August 11 over a provocative and communally-charged social media post. Three persons died of bullet injuries as police resorted to open fire to contain the escalating violence. A fourth person who was arrested by police in connection with the riots had also died due to complications of a preexisting health condition.  As a result of the arson, the house of one city MLA Akhanda Srinivas Murthy and the DJ Halli police station was partially gutted. Many vehicles were burnt among other damages to property. Incidentally, it was the MLA’s nephew Naveen who made the provocative post. He is also among the arrested.

Lockdown eased but road work hampers life on Bengaluru’s Commercial Street

Bengaluru Smart City’s remodelling work to give the entire stretch a Church Street like cobblestone makeover is going at a slow pace, shop owners say.
The once bustling Commercial Street in Bengaluru, which used to see a rush of customers and hectic business activity, wears a deserted look now. Apart from the few shoppers on the lane, the street looks like a disaster zone. One side of the road opposite the Commercial Street Police Station is cordoned off as utility lines (for power, internet and sewage) are being realigned. Due to the outbreak of the COVID-19 pandemic, business at all establishments in this shopping district had come to a standstill as it had globally and locally, but since the easing of the lockdown from May, a second factor has further dampened the prospects for business establishments of all shapes and sizes. Bengaluru Smart City Limited has started work towards redeveloping the entire street in the Shivajinagar area to give it a Church Street like cobblestone makeover. Making the lane a pedestrian-only area is also on the cards. However, the slow pace of work is adding to the woes of local businesses amidst the slowdown induced by COVID-19. The stretch between Ibrahim Street on one side and Dispensary Road on the other have outlets of multiple major retail brands as well as independent shops dealing in clothing, phones and jewellery to antiques, shoes and home decor items. Other than that, there are restaurants as well along with outlets of popular fast food chains. Yasin Pasha, who owns a small shop named Blossoms that sells ethnic wear, says business is down by 75% and even the recent Ganesh Chaturthi festival failed to improve sales.   “I’m trying to return or divert my stocks to stores in Mumbai and other cities as I don’t have money to pay the supplier. With coronavirus, business is down everywhere but at least things are picking up. But now with the road like this, I don’t see things changing here for the better anytime soon,” he tells TNM.   He says that if it rains even a little, the area turns into a mud pool, further hindering business given that many already prefer to shop online since the start of the pandemic.   Sharma, who manages a small bag store, says that while in the first week of May there was some activity, with the roadworks beginning business has again dwindled. He also says that the whole area turns into a mess once it rains and it’s even difficult for even the staff to make their way in and out of the shops. Mukesh Singh, manager at the Handloom Centre that sells furnishings among other handloom items, agrees. But he says, “It’s best that the work is happening now, given that anyway there is little business and without a vaccine there can’t be any chance of business reviving. So we can’t complain that work is going on as it will definitely make the street look attractive once the project is over.” TNM could not reach Smart City Managing Director Hepshiba Korlapati or Chief Engineer Srinivas for comment.   Incidentally, the remodelling of the Museum Cross Road, about 400 m in length, took six months to be completed and ready for use by pedestrians and vehicles.

CM Yediyurappa pitches Karnataka as FDI destination at Indo-Japan Business Forum

Chief Minister BS Yediyurappa on Wednesday pitched Karnataka as an ideal destination for Foreign Direct Investments, as he attended the Indo-Japan Business Forum Virtual Programme. Reviewing the relation between India and Japan, CM Yediyurappa spoke about strengthening the partnership further. The CM spoke about Karnataka being placed at the top in the recent NITI Aayog 2019 Innovation Index. He added that a Japanese Industrial Township near Tumakuru town was set up by the state. CM Yediyurappa said that the state government is offering many incentives for investors, including 25% capital investment subsidy on land, to boost investments in the electronic manufacturing sector. "We have simplified processes, set up a single-window for investors and engaged in regular discussion with the industry to create a stable, policy-driven environment," the Chief Minister said. While talking about India’s interest in FDI, he said, “India is also one of the most attractive investment destinations for Japanese companies. FDI from Japan to India increased from USD 1.6 billion in 2017-18 to USD 3.2 billion in 2019-20. For us in Karnataka, Japan is an important partner.” Yediyurappa said, “India-Japan relationship has transformed into a partnership of great substance and purpose. To achieve more significant economic transformation, India encourages Foreign Direct Investment (FDI) investment from Japanese companies in all sectors. India-Japan Comprehensive Economic Partnership Agreement is a comprehensive deal covering both trades in goods and services.” He also mentioned how the government has taken several steps to ensure investors find it easy to do business in Karnataka, like launching the New Industrial Policy 2020-2025, simplifying labour laws, setting up a single-window for investors and engaging in regular discussion with the industry to create a stable, policy-driven environment. The policy would introduce path-breaking changes like production-linked incentives, he said, adding: "I sincerely believe all the changes we are bringing about and your support will help Karnataka build a robust industrialised economy..."

Online classes for degree courses in Karnataka to commence from Sept 1

The Deputy Chief Minister said that while the state was ready to resume offline classes, it would wait for directions from the Centre.

The academic year for graduate courses will begin on September 1 with online classes, the Karnataka government has announced. Offline classes will commence in October,  Deputy Chief Minister and Higher Education Minister CN Ashwath Narayan told reporters. He was speaking to the media after inaugurating various development works in Ward Number 66 in Subramanya Nagar in Bengaluru. The Deputy Chief Minister added that there should be guidance on beginning offline classes from the central government. While arrangements have been made for reopening colleges and resuming physical classes, they will await the Centre’s directions. The Karnataka government has, in the meantime, decided to commence full-fledged academic programs from next month. On the issue of final year exams, Narayan said that these are schedules for all undergraduate, diploma and engineering students at the starting of the academic year as well. Backlogged exams will also be scheduled similarly. Deputy CM Ashwath Narayan commented on the controversy surrounding the National Eligibility and Entrance Test (NEET) exam. Students have been protesting against holding NEET and Joint Entrance Exam (JEE) exams amid the COVID-19 pandemic and have been asking for postponement. However, per latest reports, there is no such plan and the Ministry of Home Affairs has said that the Ministry of Education will take the final call on whether or not to go ahead with the exams next month. “The government has successfully passed CET exams for more than 1.94 lakh students in the state. In addition, 63 coronavirus positive students have also taken a good rank. But I don’t understand why a few people are against conducting NEET exams,” he said.  “Some vested interests have been trying to disrupt the NEET examination since the beginning. There is a huge network behind it. These efforts have been going on for many years. However, their purpose is not fulfilled. The NEET test is excellent. This is the practice of getting admission across the country through a test,” said the Deputy CM. He added that the state government is ready to conduct the NEET exams.

With help from Infosys Foundation, COVID-19 hospital starts in Bengaluru

The Karnataka government on Wednesday inaugurated the Broadway Super-Speciality Hospital in Shivajinagar, Bengaluru as a COVID facility. This comes four months after an announcement regarding the same was made. The hospital is equipped with cardiovascular and neurological treatment facilities and has been set up with infrastructure worth Rs 10.25 crore. This amount towards the hospital was given by author-philanthropist Sudha Murty of the Infosys Foundation.  The Infosys Foundation, led by chairperson Sudha Murty had earlier said that it will provide medical infrastructure such as ventilators and other equipment that would help equip 200-bed Broadway Hospital to treat COVID-19 patients. The Hospital was inaugurated by Karnataka Chief Minister BS Yediyurappa, who also inspected the infrastructure of the hospital. The source, however, said that they could only find the Broadway Hospital in Shivajinagar that comes under the Bruhat Bengaluru Mahanagara Palike that could fulfil a similar requirement.  Shivajinagar MLA Rizwan Arshad stated that the hospital is ready to serve people as it is equipped with the latest infrastructure to treat cardiovascular and neurological issues. He also mentioned that the hospital will be a dedicated COVID-19 facility for the time being.  Medical Education Minister K Sudhakar had earlier told reporters that Infosys had come forward to work with them. The management of the Broadway Hospital will be handed over to Infosys as they are providing facilities such as ventilators and other infrastruture. He also thanked Sudha Murty for her support.  CM Yediyurappa had earlier stated that 50% of the beds at the Broadway Hospital would be reserved for 'Corona Warriors'. BBMP Commissioner N Manjunatha Prasad had also said that that the hospital’s facilities will be made available not only for BBMP officials but also to everyone fighting coronavirus pandemic from the frontlines.
