The Karnataka High Court has said that contracting a second marriage by a Muslim may be lawful, but it causes enormous cruelty to the first wife. The Kalaburagi Division Bench, comprising Justices Krishna S Dixit and P Krishna Bhat recently dismissed an appeal to set aside a trial court judgement, which justified the dissolution of marriage in a case filed by Ramjanbi, first wife of the appellant Yusufpatel Patil. "Though contracting a second marriage by a Muslim may be lawful, it more often than not, causes enormous cruelty to the first wife, justifying her claim for divorce," the Bench observed. Patil, from the district headquarter town of Vijayapura in north Karnataka, had married Ramjanbi in July 2014 in Bengaluru as per Muslim personal law. Shortly after that, he contracted a second marriage. Subsequently, Ramjanbi filed a suit in a lower court, seeking dissolution of marriage on the grounds of cruelty and desertion, alleging that she and her parents were manhandled by the appellant and his parents. Patil then filed the petition in the High Court, saying that he loved his first wife, who is a respondent in the case. Patil had stated before the court that he contracted the second marriage "only because of the irresistible pressure mounted by his parents, who are quite powerful and politically influential". He further justified his second marriage, saying that the Sharia law permits a Mohammaden to contract plural wives "and such a conduct per se does not amount to cruelty, nor constitute a ground for opposing restitution of conjugal rights." The Bench dismissed the contention that Sharia law allows plural wives to restore the first marriage. "If this, in the given circumstances is recognised as a justification, a husband may contract two more marriages as well, seeking shelter under Sharia," the Bench observed.

Tulu Nadu's Byari language gets its own written script and numerals

The Karnataka Beary Sahitya Academy has developed a new independent script for the Beary language in coastal Karnataka, spoken by around 20 lakh people belonging to the Byari community in the region. The literature in Beary (also known as Byari), a language without script, has so far been written in Kannada. The language is mostly spoken by people belonging to the Muslim 'Byari' community in the area described as 'Tulu Nadu,' comprising coastal areas in Dakshina Kannada and parts of Kasaragod in Kerala. The new script and numerals for the language, was released by Beary Sahitya Academy chairman Rahim Uchil on Friday in the presence of members of an expert committee that prepared the script. The new language script has 46 alphabets, including 13 vowels, 33 consonants and nine numerals. Rahim Uchil said the committee has been working on the script for the last six months. Beary is a 1,000-year-old language and the academy will promote the new script through social media, he said. A new app will be launched by the academy introducing the script and numerals which can be keyed in. The new 2021 Beary calendar will be published using Beary script and numerals, which will also have the Kannada script and Arabic numerals, Uchil said. He said a request will be sent to the government to allow Beary language to be studied as a third language from the third grade in the region. According to a survey by the Education Department, more than 3,700 students in Dakshina Kannada have shown interest in the study of the language, he said. The Beary spoken language shot into fame with the 2011 movie Byari directed by KP Suveeran, which won the national award for best film that year. The film, dealing with the lives of the Byari community, was the first feature film made in the language.

K’taka drugs case: Prashanth Sambargi asked for evidence on his claims against ex-Min

The Central Crime Branch (CCB) of Bengaluru, probing the high profile drugs bust case involving stars in the Kannada film industry, on Saturday grilled realtor-turned-social activist Prashanth Sambargi and sought more documents from him to support his claims in the case.  Since the issue of drug-related allegations came up against some Kannada film stars, Sambargi has been issuing statements in the press about his knowledge of the same. He also had alleged that Congress leader Zameer Ahmed Khan and his aides were also involved in drug smuggling. Following this, he was summoned by the CCB to aid the probe. Apparently unsatisfied over the documents, the CCB has summoned Sambargi to appear before it next Friday with more documents. "There is a lot of difference in his claims and documents surrendered to us. When we questioned him to produce incriminating evidence, he had sought at least a week's time. That is why we have asked him to appear next Friday," a CCB official said. Speaking to reporters after his visit to the CCB office, Sambargi said, "I will definitely cooperate with the police. At present, they have asked me to submit some more documents, which I will procure by next week (Friday)," he claimed. In an apparent ‘u-turn,’ however, Sambargi has now asserted that he was not targeting former Minister BZ Zameer Ahmed Khan but that his target was Sheikh Faizulla, who has been the Congress leader’s close associate and is known for criminal activities. "Who am I to target him (Zameer)? I am here to tell the truth about Faizulla," he said. Incidentally, Prashanth has been booked for defamation after a Bengaluru court directed a probe while hearing a plea by the former minister and Congress MLA Zameer. It may be recalled that earlier in the day, prior to visiting the CCB police, Samabargi made startling remarks that the faux-leather folder which he is carrying contains concrete evidence against Khan and the former minister will have to ready to hand over his entire property to the state government. "Truth is in this file. I am the torchbearer of the truth. After I hand over this to police, Khan should start making preparations to hand over his property," he had declared. In response to a question, Sambargi angrily reacted that he never believed in making frivolous statements or false statements.  "Media can check my track record, whatever I have been stating on TVs for the last three months have come true. I have nowhere said that he was involved in drug-related cases. I just said that he was in Colombo on July 8, 9. and 10 in 2019. Even this statement has come true," he declared. He further added that he had not handed over any documents related to Kannada actor Sanjjanaa Galrani.  "I am here next week again. My battle is not with any individual but it is against the mafia. I am fighting for a cause not for glory or for any gains. My only intention is to provide all information about the drug mafia that is spreading its tentacles in our film industry and among youths in the state," he explained. Meanwhile, taking a serious note of the allegations made by Sambargi, former minister Khan asserted that he does not want to reply to him through the media, he would give all replies and explanations in the court of law.

After three priests killed at Mandya temple, govt decides to open hundis once a month

A day after the horrific triple-murder of priests at a centuries-old temple in Karnataka’s Mandya, Srinivasa Poojari, the Minister of Muzarai (Hindu Religious Institutions and Charitable Endowment) on Saturday said the Karnataka government will take steps to open temple hundis (collection boxes) once a month to avoid such tragedies.  At present, the Muzarai department opens the Hundis once in three months and collects the accumulated cash offerings. But in the case of Arkeshwara temple, located on the outskirts of Mandya city, the hundi had not been opened for the last ten months. As a result, the 'hundi' contained a large amount of cash, and during an attempt to steal the same, the three priests are believed to have been murdered. According to the police, the hundis are opened especially in presence of Muzarai department’s assistant commissioner which is a must for an "A" category temple while a Tehsildar's presence is required in "B" category temples. Speaking to reporters after handing-over the Rs 5 lakh ex-gratia cheque to family members of the deceased in Mandya, Poojari directed the department Commissioner Rohini Sindhuri to take steps to repair dysfunctional CCTV cameras inside and outside temple premises. In particular, it was Mysuru which was affected adversely. As a result, entire government machinery was completely busy with tackling the pandemic and the district administration's priorities changed. Hence, the hundi collection was not taken out. The assailants must have sensed this and decamped with the hundi cash by killing three priests," an officer added. "The Arkeshwara temple has a custom that a family which performs the first pooja is only entitled to carry out the pooja in this temple. Over the centuries the family has grown to such an extent, each of the family members gets only two or three days in a year to be the priests of this temple," the officer explained. Meanwhile, speaking to IANS, Superintendent of Police, K Parshuram said that the police have formed special teams to probe into the murder and circumstantial evidence indicates that it was murder for gain. “Based on our clues we are tracking a nomadic gang, we have kept a close watch on the movements, I am hopeful that culprits will be nabbed soon," he added.

Govt will take action against whoever’s found guilty in drugs probe: Karnataka Minister

Karnataka Minister Sudhakar was responding to Congress leader Siddaramaiah’s criticism that the BJP government was diverting attention from the COVID-19 through the drug busts.
Karnataka Medical Education Minister K Sudhakar hit out at former Chief Minister Siddaramaiah over claims that the BJP in Karnataka was misusing the probe into the drug bust in the state.  Speaking to media persons after attending a Teachers' Day celebration at Chikkaballapura, Sudhakar said, "To protect the youth from drug abuse, strict regulations must be introduced in the state. The society will be affected if the youth are not protected and led in the right direction," Sudhakar said.  He said that successive governments have not done enough to counter drug peddling. He stated that the government will take action no matter how powerful they are. "BJP government will take actions against whoever is found guilty in the drug probe despite their financial status, community or religion," he said.  Siddaramaiah had said that the BJP government in Karnataka was diverting attention from the COVID-19 crisis through the drug bust and accused the BJP of protecting its own leaders.  Sudhakar's statements come at a time when a series of drug busts have taken place in Karnataka. Those accused of being part of a drug ring include Sandalwood actors Sanjjana Galrani, Ragini Dwivedi and party planner Viren Khanna.  Ragini Dwivedi had campaigned for the BJP in the 2019 bye-elections but the party has disassociated itself from the actor ever since her name figured in the drug bust case. The Central Crime Branch, probing the drug menace among the bigwigs of Karnataka including film actors, arrested one more person in connection with the case, police said on Saturday. With this, the number of those arrested so far in the drug abuse case went up to 10. "Vaibhav Jain, accused in the drug case, has been arrested," the CCB said in a statement. CCB have launched a crackdown against the drug menace after the Narcotics Control Bureau arrested three people, including a woman, who were allegedly supplying drugs to the Kannada film actors and singers. The police have registered cases against 14 people. Besides the CCB, the Enforcement Directorate has also started probing into the financial aspect of the case.

NLSIU announces 94% attendance in NLAT 2020, but many point out technical glitches

Many candidates appearing for the National Law Aptitude Test (NLAT) 2020 on Saturday said that the online test was marred by technical glitches and they were unable to write the exam and did not get support from the authorities as well. The examination is for the admission of aspirants into Bengaluru's National Law School of India University (NLSIU). Speaking to TNM, a candidate said that he was unable to log onto the examination since his photo identity was not verified. "I logged in without any problem and uploaded the government issued photo identity at 12:00 pm and my exam was set to begin at 12:30 pm. We had to upload it before the examination. But I did not get the opportunity to write the examination since I was not verified. I waited till 2 pm but there was no update. I called the technical support staff but I was told that I should contact the university itself," says the student.  Another student told TNM that she experienced similar glitches and despite sending emails to the university, she did not receive a response and could not write the examination.   Many others took to social media to complain about the similar issues.  #nlat #NLAT2020 has been an absolute disaster.
