'If you think I will be silenced, you are dreaming': DK Shivakumar after CBI raids

The Central Bureau of Investigation on Monday concluded the search and seizure operation at various properties belonging to Karnataka Pradesh Congress Committee President DK Shivakumar 13 hours after it began. At 6 am on Monday CBI sleuths simultaneously searched 14 properties belonging to Shivakumar and his brother, Bengaluru Rural MP DK Suresh.  The CBI also registered an FIR against Shivakumar. Speaking to the media after the search concluded, Shivakumar said, “I want to ask the CM one thing. You have given permission to the CBI to conduct a probe. So why was the FIR registered on September 30? Why could they not do it before? Why did they do it after I announced my plans to protest?”  DK Shivakumar said, while referring to the announcement that he would spearhead the protest in Bengaluru in connection with the Hathras rape case.  He said that the CBI found Rs 1.47 lakh at his residences and nothing more. He said that the reports that a huge amount of cash was found was false. When asked about the CBI’s statement about the allegation of disproportionate assets, he said, “Let them hang me then. The property value has increased since I purchased it. They are asking market value. CBI has given a check period from 2013 and 2018. Let them investigate. I don’t mind. I am a law-abiding citizen.”  He said that he would fully cooperate with the CBI’s probe and maintained that the searches were politically motivated. “Before these IT raids, was there any criminal case against me in my political life? Have I ever been involved in any corruption case before? Especially when I was the Cooperation Minister, Energy Minister and Water Resource Minister? No. You have turned over all the documents now and what have you found? Go ahead and investigate,” he added.  Shivakumar challenged Chief Minister BS Yediyurappa and said that he would not be mowed down by intimidation tactics. He questioned Yediyurappa and indicated that the cases against him were pre-planned. “Chief Minister, tell me one thing. Have you planned how many times I have to be investigated and how many times I have to go to jail?” he said.  He said that his friends and family have been harassed for the last few years due to the “politically-motivated cases” against him. “Is DK Shivakumar the only person you found? If you think you can silence me, you are dreaming. I am strong, I have my people, my national leaders and until they are with me, I will not be mowed down by this intimidation. This is purely politics and if you want to indulge in politics, let’s go talk to the voters,” he added.  CBI registers FIR After the search concluded, the CBI said that an FIR was registered against Shivakumar stating that he was allegedly in possession of disproportionate assets worth Rs 74.93 crore in his name and in the name of his family members.  The CBI registered the FIR on October 2.  In September 2019, the Karnataka government had granted permission to the CBI to launch a probe against Shivakumar. Subsequently, the Union government too had granted permission after which the CBI began its probe in March 2020 against Shivakumar and his associates.  “Searches were conducted today at 14 locations including Karnataka, Delhi, Mumbai at the premises of said MLA (DK Shivakumar) and others which led to recovery of cash of Rs 57 lakh and several incriminating documents including property documents, bank related information, computer hard disk etc. Investigation is continuing,” the CBI said in a statement. The CBI launched a probe against Shivakumar after the Enforcement Directorate shared information related to his finances with the agency. The ED is probing the money laundering case against Shivakumar. The ED had arrested him in September 2019 and he was in Tihar Jail for 51 days before the Delhi High Court granted him bail.  The ED had accused Shivakumar of laundering black money through various proxies including his family members and close associates.

BJP National General Secretary C T Ravi on Monday said D K Shivakumar should cooperate with the CBI in its investigation as the central probe agency searched multiple premises in connection with a corruption case related to the Congress' state unit chief and his brother. The Central Bureau of Investigation (CBI) has till now recovered Rs 50 lakh from 14 locations in Karnataka, Delhi and Maharashtra it has searched in the case that pertains to amassing of disproportionate assets, officials said. Following the raids, the Congress' Karnataka unit has accused the BJP of using the CBI as an electoral weapon. However, Ravi, a former Karnataka minister, said, "The CBI is doing its work. If the Congress leader is clean, he should cooperate and tell the truth." He also sought to know if D K Shivakumar's economic growth was natural as his assets grew from Rs 75 crore in 2008 to Rs 250 crore in 2013 and Rs 840 crore in 2018. "You can respond to political issues standing in the street, but about illegal acquisition of money or illegal transfer of money, one has to respond to CBI or ED," the BJP leader said. "There is no problem in making assets, but one needs to reveal the source of the money. If crores of rupees is kept in the name of his daughter who is still studying, he ought to respond to the CBI," Ravi added. The CBI has registered a fresh case against the Congress leader based on source information from another agency. The information relates to assets amassed during Shivakumar's tenure as a minister in Karnataka, officials said. Following the registration of FIR, CBI teams started searches on Monday morning at 14 locations -- nine in Karnataka, four in Delhi and one in Mumbai. According to sources, places that are being searched include properties of Shivakumar's brother and MP from Bengaluru Rural D K Suresh.

CBI raids on DK Shivakumar’s properties serve a dual purpose, insiders tell TNM

It is not the first time that Congress strongman, DK Shivakumar is being raided by a central agency. DKS, as he is popularly known, has been under the scanner of the Income Tax department and the Enforcement Directorate for months now. But this time, he could be under the scanner of the Central Bureau of Investigation (CBI) for two reasons, insiders from both the BJP and Congress tell TNM. When the news of raids at various locations related to the DK brothers started trickling in, their party colleagues, right on cue, started accusing the CBI of doing the Union Government’s bidding and the Modi-led Centre of indulging in ‘vindictive politics.’ But the move was not really a shocker, say sources in Karnataka Congress. Many had seen this coming for a long time and had almost anticipated this too. But they say that they didn't think the CBI would wait this long, and had predicted trouble from the central agency just after DKS was promoted as the president of the Karnataka Congress unit. That said, the timing now also makes sense, allege sources in Congress. With the party facing elections for the first time since DK Shivakumar took charge, it was bound to be a prestige issue for him and that he would ensure that the party does not fall short of funds for campaigning. So the CBI search operation, many believe, is to choke the funds supply ahead of the upcoming byelections slated to take place in Sira and RR Nagar. But the second reason, many in BJP believe, is to highlight ‘corruption’ in the Congress after the principal Opposition went after a key member of Chief Minister BS Yediyurappa’s family in an alleged corruption scandal. The Congress, in a press conference on September 23, had demanded Yediyurappa’s resignation and an independent probe into the allegations raised by Power TV’s sting operation and also went after the CM fiercely in the Assembly. Power TV, a private Kannada television channel, ran a series of programmes last month using the audio of a sting operation allegedly done by an official in the channel on a member of the Chief Minister's family. This was another trigger for the Union Government to pursue cases against DKS that had been put on the back burner temporarily, say insiders in the BJP. The decision by the Congress party to ferociously go after the CM’s family was made by a senior leader from Delhi, much against the advice of senior state leaders including DK Shivakumar, say those who were privy to the meeting. The CBI, on Monday, started a search and seizure operation at DK Shivakumar and his brother DK Suresh’s residences in Bengaluru and Kanakapura along with 15 other properties belonging to the brothers. On August 2, 2017, the Income Tax department had raided Shivakumar’s residences and offices in Bengaluru, Kanakapura, Chennai, Mysuru and New Delhi. The raids spanned across 80 locations and concluded after three days. On 3 September 2019 DK Shivakumar was arrested after he was questioned for nine days in Delhi.  He was charged for  money laundering and income tax evasion. On October 23, the ED court granted him bail.

'Secret' proceedings in UK delaying Vijay Mallya's extradition: Union govt tells SC

The union government on Monday told the Supreme Court that a "secret" extradition process was going on to bring fugitive businessman Vijay Mallya to the country but it was not aware about its status. The Centre also told the top court that it was not a party to the proceedings. A bench of Justices UU Lalit and Ashok Bhushan asked Mallya's lawyer to inform the court what kind of "secret" proceedings are going on to extradite him. Advocate Ankur Saigal, appearing for Mallya, told the apex court that he was not aware what kind of proceedings are going on. He said, "I have knowledge that my request against extradition has been rejected". The bench also directed Mallya's lawyers to apprise it by November 2 when the fugitive businessman will appear before the court and when the "secret" proceedings are going to end. Advocate Rajat Nair, appearing for the Centre, told the court that extradition request has been made as per the direction of the court. "Some secret extradition proceedings are going on to which we are not a party. Extradition proceedings have been upheld by the highest court of UK but it has not been happening as of now," he said. The apex court had earlier directed Mallya to appear before it on October 5 while dismissing his plea seeking review of the 2017 verdict which held him guilty of contempt for transferring USD 40 million to his children in violation of court orders. Mallya, an accused in bank loan default case of over Rs 9,000 crore involving his defunct Kingfisher Airlines, is in the United Kingdom. The apex court had in June directed its registry to explain as to why Mallya's review petition had not been listed before the concerned court for the last three years. It had directed the registry to furnish all the details including names of officials who had dealt with the file concerning the review petition in the last three years. The apex court's 2017 order had come on a plea by consortium of banks led by the State Bank of India (SBI), which had said that Mallya had allegedly transferred USD 40 million received from British firm Diageo, to his children in "flagrant violation" of various judicial orders. It was dealing with pleas of lending banks seeking contempt action and a direction to Mallya to deposit USD 40 million received from offshore firm Diageo respectively. The banks had then alleged that Mallya concealed the facts and diverted the money to his son Siddharth Mallya and daughters Leanna Mallya and Tanya Mallya in "flagrant violation" of the orders passed by the Karnataka High Court. Mallya had in May lost his application seeking leave to appeal his extradition to India in the UK Supreme Court, setting a 28-day clock on his removal from the UK. The UK top court's decision marks a big legal setback to the 64-year-old flamboyant businessman, who had earlier lost his high court appeal against an extradition order to India on charges of alleged fraud and money laundering related to unrecovered loans to his now-defunct Kingfisher Airlines. Mallya has been based in the UK since March 2016 and remains on bail on an extradition warrant executed three years ago by Scotland Yard on April 18, 2017.

The Congress youth wing on Monday held protests at various locations in the state condemning the search and seizure operations conducted by the CBI at various properties belonging to Karnataka Pradesh Congress Committee President DK Shivakumar and his brother, Bengaluru Rural MP DK Suresh.  Members of the National Student Union of India, the youth wing of the Congress party, held protests outside Chief Minister BS Yediyurappa’s residence in Shivamogga’s Shikaripur and attempted to lockdown the house. The Shikaripur Police detained around 15 protesters after they attempted to lockdown the CM’s residence. Yediyurappa’s family members were inside the house when the protests were held.  Simultaneously, protesters gathered at Maurya Circle in Bengaluru to condemn the search operations at Shivakumar’s properties. NSUI activists gathered outside Shivakumar’s Sadashivnagar residence in Bengaluru and sat down in protest while holding placards. “We want justice, we want justice”, “Down down CBI,” the protesters shouted.  Several Congress leaders condemned the CBI’s search operation and called it political vendetta by the ruling BJP. DK Shivakumar’s counsel AS Ponnanna said that the CBI was acting on orders from its political bosses.  “The Karnataka High Court on September 28, issued an interim order and had said no coercive steps should be taken against DK Shivakumar until the case is over. We had filed a writ petition and had asked for a stay on the CBI’s probe. The state government had given CBI permission to conduct a probe in September last year. This raid is completely against court orders and is illegal. The CBi is acting on orders from its political bosses,” Ponnanna said.  The BJP meanwhile called the protests ridiculous and meaningless. BJP spokesperson Ganesh Karniak said, “CBI is doing its job. The present raid is in continuation of investigations started by ED in 2017,” he said. Meanwhile, Deputy Chief Minister Dr CN Ashwath Narayan said that the investigation is independent of politics and the Congress party’s move of “painting it politically” is incorrect. “Income Tax department and Enforcement Directorate had earlier raided Shivakumar and CBI raids may be a continuation of it, so let's not paint it with political colour. The system is bigger than one person. Let the truth come out. It is not right to do politics on such a delicate issue. Some people are trying to get mileage by terming it politically motivated. There is no connection between the raids and the by-elections,” he said.
