Prime Minister Narendra Modi is "very much worried" about the recent violence at the Wistron's iPhone manufacturing plant in Karnataka, Chief Minister BS Yediyurappa said on Thursday, as he assured his government's full support to the company for restarting production. The government has given necessary instructions and such things would not be repeated, he told reporters in Bengaluru. "We have taken action, It is a very important foreign company and this (incident) should not have happened. The Prime Minister is also very much worried about this development," Yediyurappa said. "We will give full support to that company, without any problem let them continue production," he added. A section of workers at the plant, run by the Taiwanese contract manufacturer for Apple at Narsapura in Kolar district, had indulged in vandalism on Saturday over alleged delay in payment of salary and overtime wages. Over 160 people have been arrested by the police in connection with the violence during which stones were hurled, windows and doors broken and vehicles in the parking lot overturned and set on fire. Video footage of the attack was widely shared on social media. State Labour Minister Shivaram Hebbar on Wednesday had said that investigations into the violence were on and a report was likely to be filed in a couple of days. He expressed hope about the factory restarting production soon with the Union government also involved in addressing issues. The Union Commerce and Industry Ministry has advised the state government to complete the inquiry into the violence at the earliest and to ensure that investor sentiment was not affected by this one-off incident. Meanwhile, state Home Minister Basavaraj Bommai in a tweet said that the police has taken prompt action in connection with the incident and arrested 164 people. "The Wistron company which said Rs 437 crore loss earlier, now has in writing (said) that loss is Rs 43 crore, therefore, some international media is blowing (it) out of proportion," he said. The Karnataka government on Thursday issued orders barring parties at clubs in Bengaluru on New Year's Eve. The government order also called for strict safety rules to be implemented during Christmas celebrations in the city amid the COVID-19 pandemic. From December 30 to January 2, clubs in the state including in the capital city of Bengaluru will not be allowed to organise DJ nights or dance parties like previous years. However, they can remain open as usual, the order signed by Karnataka Chief Secretary TM Vijay Bhaskar stated. The order added that Christmas celebrations should be held enforcing strict physical distancing and wearing of masks. Malls, restaurants and other establishments in the city will also have to screen temperatures of people who enter.  Earlier, Karnataka Health Minister Sudhakar K had said that public gatherings from December 20 to January 2 will be restricted to 200 people. He added that it is for religious gatherings, political gatherings, marriages, and Christmas celebrations and that residents in the state should celebrate in a safe manner. "New Year Eve celebrations in public places and high streets like MG Road and Brigade Road in the city centre are banned to prevent crowding and avoid large gatherings, which pose risk of spreading the infection," Sudhakar said. "Citizens can have the New Year Eve bash at their homes and residential areas by wearing masks, maintaining physical distance and sanitising their hands to ensure their safety in pandemic times," added Sudhakar. Meanwhile, orders issued during Diwali specifying the use of green crackers will be extended to Christmas and New Year's Day.

Karnataka’s pvt school teachers stage protest in Bengaluru, demand to be paid

The teachers say that they were unpaid and underpaid during the pandemic, forcing them to take up other occupations to stay afloat.

The teachers of private and unaided schools across Karnataka came to Bengaluru on Wednesday, staging a protest to demand the state government to pay them their salaries. The teachers took out a rally from Maurya Circle to Freedom Park in the city, to get the state government to notice. The teachers were seen pushing vegetable and fruit carts symbolizing their plight, as many teachers were not paid their salaries or were underpaid during the pandemic. The protest was led by Associated Managements of Primary and Secondary Schools in Karnataka. “We made noodles and sold them [during the lockdown], began making dry fruit packets for sale, sold vegetables and tried to sustain ourselves. Some teachers even began working as domestic workers to stay afloat. The government gave everyone a relief package, but ignored us,” said Ranga Lakshmi, principal and teacher at Basaveshwara High School. “Managing households and our families became difficult. We not only had to pay rent but also others bill and provide for our children’s education too. I had to take loans to be able to make the ends meet,” added Prasheela, a teacher at Trinity High School. The teachers put forth their demands while protesting. Primarily, they asked to be provided with the free vaccine in the first phase of vaccination. They also demanded the government to issue a notice on the re-opening of schools, enrollment, payment of fees, attendance, evaluation and finalization of revisions in the curriculum “We want the state government to provide free medical insurance to the teaching and the non-teaching staff as well as food kits,” said Shashi Kumar, General Secretary of Associated Managements of Primary and Secondary Schools in Karnataka. Besides teachers, even the management of private and unaided schools are suffering. Recounting her woes, Rama Mani of Trinity High School said that they are struggling to repay loans, and had to pay taxes too, despite little to no collection of fees. The protesters pointed out that another issue that may soon crop up is a shortage of educators. There has been a rise in the efflux of teachers since the pandemic, as schools remained shut and management had exhausted their funds. “There will be a shortage of teachers after a while since many have already left their jobs and vow to never return,” added Lakshmi. Karnataka Home Minister Basavaraj Bommai and Revenue Minister R Ashok, on the Chief Minister’s orders, visited the protest site on Wednesday and assured the teachers that they will pay heed to their demands and promptly help them. They requested the teachers to call off their strike.

Karnataka HC rules married daughter can also apply for job on compassionate grounds

On Thursday, the Karnataka High Court ruled that married daughters are also entitled to seek employment on the grounds of compassion, emphasising that a woman after marriage doesn’t cease to be a part of the parental family. The court also directed the government to consider petitioner Bhuvaneswari Puranik’s appeal for a job in one of its departments. The petitioner Bhuvaneswari’s representation for a job on compassionate grounds was rejected because she is married. Her brother chose not to seek the appointment on the grounds that he was not willing and is employed at a private firm. The father of the petitioner, Ashok Adiveppa Madivalar, who worked as a secretary in the office of Agriculture Produce Marketing Committee in Kudachi, Belgaum district, died in 2016 on the job. His daughter’s application for the job was rejected by the Joint Director (admin), Department of Agriculture Marketing. Subsequently, Bhuvaneswari challenged the order at the High Court, citing that it is discriminatory. The High Court—striking down rules which considered only an unmarried daughter as a family member—said that exclusion of married daughters from the purview of ‘family’ is discriminatory and unconstitutional under the Karnataka Civil Services (Appointment on Compassionate Ground) Rules, 1966. Justice M Nagaprasanna said that the rules are discriminatory and violate Articles 14 and 15 that prohibit discrimination based on race, religion, sex or gender. The court noted that the factor of dependency, the key to grant or deny compassionate appointment, was not even considered in the case at hand since the definition of 'dependants' and 'family' exclude the daughter who is married. The order read, “if the marital status of the son doesn’t affect in law to his entitlement for seeking an appointment on compassionate grounds, then the marital status of the daughter should not make a difference either. Law cannot assume that only married sons alone continue to be a part of the family.”   The Punjab and Haryana High Court had in July 2020, announced that married daughters of a deceased government employee can be considered for compassionate appointment.

Karnataka Labour Dept finds Wistron did not record deduction in pay for workers

Contract employees at Wistron’s iPhone manufacturing unit in Karnataka’s Kolar were not given offer letters, employment contracts and were denied salary slips on request, the Karnataka Labour Department has found. “When asked to produce, the (company) did not,” the report says. The inspectors also found that contract employees were not given offer letters, employment contracts and were denied salary slips on request. The report indicates that contracting companies including Quess Corp, Adecco India Ltd and Creative Engineers violated norms related to hiring personnel. However, it does not specify whether the other violations it noted were incurred by Wistron or the contracting companies.  The Karnataka Labour Department visited the plant on December 12, the day thousands of disgruntled workers vandalised the factory, alleging that their repeated requests to pay deducted wages and overtime amounts were stonewalled. The Labour Department found several violations of the Contract Labour (Regulation and Abolition) Act 1970 and the state government’s rules pertaining to this legislation. The inspection was conducted by Kolar district’s inspectors working in the Labour Department -- Lokesh Kumar and Renuka Prasad.  Sources with the Labour Department told TNM that a report including the inspection’s findings were sent to the Union Labour Ministry. “We don’t know what action the Union government will want us to take. In such a situation, the contracting companies could be blacklisted,” a senior official with the Labour Department said.  The Labour Department official also said that its “findings” based on multiple inspections and interactions with company representatives indicate violations by the contracting companies. What the report states The report, signed by Rajeshwari, the Labour Officer in Kolar district Labour Office, noted that contractors including Quess Corp Ltd, Adecco India Ltd and Creative Engineers had hired more people without prior approval of the labour department. “Contracting companies Creative Engineers and Quess Corp Ltd, had obtained permission to hire 2,350 and 1,350 employees for Wistron. They hired 2,410 and 1,511 personnel in total and had not obtained permission to hire the additional employees. Adecco India Ltd had obtained permission to hire 3,000 employees but they hired 111 additional personnel without prior approvals,” the report added.  However, the most important finding was that the workers salaries were deducted, which was in violation of the Contract Employees (Regulation and Abolition) Rules. According to the rules, salaries can be deducted if there is a record of employees taking unpaid leave, or if it is proved that any damages were caused to the company’s infrastructure due to the said employees’ action. “No explanation was given regarding the deduction in pay,” the report noted. TNM spoke to several employees who stated that every month three or four days’ pay was deducted despite them having worked those days and that this had gone on for over six months. Employees said that despite multiple requests submitted to Wistron’s to the HR Department, no action was taken to rectify the deduction in pay. An earlier report submitted by the Department of Factories, Boilers and Industrial Safety, had stated that overtime wages for the housekeeping staff were not paid. The report also stated that the company violated section 8 of the Minimum Wages Act where complaints of employees were not officially recorded.  The report also found that the company had violated norms under the Industrial Employees (Standing Order) Act 1976, where the management’s decisions were not effectively communicated with the employees. However, this report does not specifically state whether these violations were incurred by Wistron specifically or the contracting companies. What the human resource contracting companies claimed A source at Quess Corp told TNM on condition of anonymity that Wistron hasn’t been able to meet with the increased workload coming its way, especially after the lockdown ensuing the pandemic. “They went up from 2,000 employees to nearly 10,000. The unprecedented increase in workforce in a rather abnormal pandemic situation impeded their ability to put systems that would have enabled them to discharge their fiduciary responsibilities,” the source said. He also said that Wistron had failed to maintain a good relationship with its workers. “If there is an issue at the plant, they should have been able to call somebody, there should have been community connect that they generated like someone to mediate between bureaucracy and legal resources. Hence there was a rampage. And that’s where I think the focus should be as you analyse this issue,” the source added. Industry sources also say that service providers such as Quess Corp, which is a listed company, are expected to follow the same level of governance as a Wistron or Apple is, and as service providers, they will also begin looking at clients keenly and whether or not they want to work with them and under what circumstances. Is Wistron accountable? Employees that TNM spoke to said that when they approached Wistron’s HR Department, they were informed that the company had handed over wages to the contracting companies. When employees approached the contracting companies, they were informed that payments disbursed by Wistron were made and that the contracting companies only disbursed the money received from Wistron, the principal company.  Speaking to TNM, Professor Matthew Babu, adjunct professor at National Law School India University in Bengaluru and Director of Centre for Labour Studies, said that both the contracting companies and the principal company, in this case Wistron, are accountable to ensure that labour laws are not violated.  “The principal employer should ensure that the wages are paid properly and it should appoint personnel to monitor whether contracting companies are also following these norms. They can’t escape so easily. First of all they get labour at cheapest price and don’t pay minimum wage and overtime, which is a violation of the Minimum Wages Act,” he said.  He said that such lack of monitoring would be counterproductive to increasing investment in Karnataka as employers would prefer to work in states where such systems are in place and function properly. “It is the job of the principal company to ensure that all contract employees are registered and should ensure that management’s decisions are communicated properly. This seems like a blame game,” he added.

Eminent businessman RN Shetty, credited with modernising Murudeshwara, dies in Bengaluru

Eminent businessman and philanthropist R N Shetty died at his residence in Bengaluru due to a cardiac arrest in the early hours of Thursday, family members said. He was 92 and is survived by his wife and three sons. Born on August 15, 1928 at Murudeshwar in the coastal district of Uttara Kannada, Rama Nagappa Shetty founded the RN Shetty and Company in 1961 and ventured into the construction industry with focus on infrastructure building. He built tunnels for the railways, dams, canals, bridges, and buildings in various parts of Karnataka and neighbouring states. Later, he entered the hospitality and education sector and left a mark there as well. Among other institutes, he founded the RNS Institute of Technology in Bengaluru. His remains will be kept at the institute before the funeral on Thursday. The institute is located in Uttarahalli in the city. The Federation of Karnataka Chambers of Commerce and Industries had bestowed on him the Visvesvaraya Memorial Award in 2004 and the Bengaluru University conferred an honorary doctorate in 2009. RN Shetty had undertaken modernisation of the historic Murudeshwara Temple, which his ancestors had served, and was instrumental in building the 249 ft tall Raja Gopura of the temple. Condoling the philanthropist's death, Chief Minister BS Yediyurappa said Shetty, who was born in a peasant family ventured into various businesses and left a deep imprint in the construction, infrastructure development, hospitality and education sector. Remembering him as 'Mahadani' (great philanthropist), former Prime Minister H D Deve Gowda said, "I am deeply pained to learn about the demise of great philanthropist and businessman Dr R N Shetty who had founded various education and religious institutions." Others including Congress leader and former Revenue Minister RV Deshpande paid glowing tributes to RN Shetty.

Bengaluru police arrest paramedical student for alleged rape and murder of 20-yr-old

Bengaluru police is investigating the alleged rape and murder of a 20-year-old nursing student who arrived in the city from Assam on Monday. The student joined a college in Bengaluru for a course in nursing and her family said that her admission was done through Anisur Rahman, a 21-year-old student at the same college who is also from Assam. Anisur was arrested by the police on Wednesday in connection with the murder. The first information report registered at the Byadarahalli police station in the city mentions charges of rape and murder. The victim was brought dead to Anupama Hospital in Yelahanka in Bengaluru on Wednesday by the accused Anisur Rahman. According to the police complaint filed at the Byadarahalli police station, Anisur alerted his neighbours that his girlfriend was unconscious on Wednesday morning around 10:30 am.  The police complaint filed by the landlord states that the victim was unconscious and there was bleeding in her genitals. She was rushed to the hospital in Yelahanka by Anisur and his friends.  While the victim hails from Goalpara district in Assam, Anisur Rahman is from Barpeta district in Assam. The victim’s family members say that she did not know Anisur and that he was only helping her with the admission process in her college in Bengaluru. According to a lawyer connected to the case, the nursing student arrived in Bengaluru on December 14 and contacted Anisur two days later on Wednesday asking for help to encash a cheque of Rs 1.5 lakh. Hours later, she was brought dead to Anupala Hospital by Anisur.  According to the police, preliminary investigations suggested that the victim was raped and murdered.  "We will know more after the post-mortem is completed. One of the accused - Anisur Rahman - is arrested and the preliminary investigation suggests a case of rape and murder," said Rajeev A, a police inspector from Byadarahalli police station who is investigating the case.  "But we have found that they are both from Assam and they are possibly friends from before because the victim's father knew the accused person Anisur. The woman had just reached Bengaluru this week to start her nursing course and we are investigating what she did from the time she reached here," said the police official. According to the investigating police, Anisur Rahman claimed that the victim started bleeding and fell unconscious when they were having consensual sex. However, police are waiting for the post-mortem report to shed more light on this. "We have not found any struggle marks on the body but we can confirm only after the post-mortem report is submitted," another investigating officer said. However, the victim's family said that the police should speed up their investigation and claimed that there are two other persons involved in the case who are currently absconding.
